In Ohio, many families are covered under a single medical insurance family policy, either a private one or a policy obtained through one spouse’s employer. When people file for divorce, some have the mistaken belief that they can remove their spouse from their medical insurance policy as soon as the paperwork is filed.

Ohio law specifically enjoins people from doing several things while a divorce case is pending. It is considered to be against public policy to force another person into an uninsured status. Thus, the law prohibits either the petitioner or respondent in a pending divorce case from terminating the other party’s health insurance coverage.
